The Supreme Court says that the CA exams must be conducted in a flexible manner when the situation is not static. SC asks the Institute of Chartered Accountants of India (ICAI) to consider the option of opting out even at the time of examination. Hence, ICAI demanded the time till July 2 for the issuance of the fresh guidelines regarding the current year’s CA exams. Hence, the vertex court (SC) also ordered the ICAI to consider the permission to the students to opt-out of the exams until the last date.

Amid the current pandemic scenario, ICAI announced the exam dates of this year which were scheduled from July 29 – August 16, 2020. As per the statement given by the Justice AM Khanwikar, “Those students who will not opt-out in the ICAI exams would not be permitted to appear in the examination in the increasing number of cases of COVID 19 in the country circumstances and thus the benefits will not be provided to such students compared to those CA exams aspirants who have opted-out for the same.
During the hearing of the plea, the top court also mentions that a particular area may be a containment zone (COVID 19) so that the chance to opt-out the examination center should be until the last week of July. Besides, a statement was also made by the petitioner’s counsel Alakh Alok Srivastava, “There should be one examination center in a district. Approximately 3,36,000 candidates are registered for the exam while around 53,000 have selected the opt-out option.”
